REGISTER
OF PROBATE RICHARD IANNELLA CONFIRMS THE FILING OF PETITIONS
TO PROBATE THE ESTATE OF YETTY MILENA DEL VALLE:
Suffolk
County Register of Probate Richard Iannella confirmed today
that an attorney for Angel Del Valle appeared in Suffolk
County Probate and Family Court this morning to file a
Petition for Administration and a Petition for Special
Administration of the estate of Yetty Milena Del Valle.
Ms.
Del Valle was killed on July 10th after being
struck by a collapsed ceiling panel in the I-90 connector
tunnel in Boston. Her husband seeks the appointment as
Administrator of her estate.
“All
next of kin and heirs at law have to be notified of a Petition
for Administration, as they can either consent to or oppose
the appointment,” explained Register Iannella. “In this
instance, with her three children in Costa Rica, the process
of formally obtaining their consent will take some time.
Someone has to make important decisions and deal with estate
matters until then, and that’s why a second Petition for
Special Administration was also filed with the court and acted
on today.”
As
part of the Petition for Special Administration, Attorney
Jeffrey Denner cited an urgent need for a representative of
the estate to be named by the court: “It is critical that
a Special Administrator be appointed to employ agents on the
Estate’s behalf to preserve evidence in a wrongful death
action and to file a claim on the Estate’s behalf relative
to same and to participate in all aspects of said
litigation/matter.” he wrote.
By
approving the Petition for Special Administration today, First
Justice Judge Smoot has given Angel Del Valle (who did not
appear in court with his attorney) a ninety-day appointment as
Special Administrator of his wife’s estate. Judge Smoot has
also ordered that a $2,000 corporate surety bond be posted in
this case.
“Once
all formal legal notice has been given and the proper assents
made, Mr. Del Valle can move forward with a full, permanent
appointment as Administrator of his wife’s estate,” said
Register Iannella. “Until then, though, his appointment as
Special Administrator basically gives him the same authority
to make decisions and act on behalf of the estate on a
temporary basis for the next three months.”
